A BILL
To provide emergency
market loss assistance for producers of red raspberries for the processed
market.
Be it enacted by the
Senate and House of Representatives of the United States of America in
Congress assembled,
SECTION 1. MARKET LOSS ASSISTANCE
FOR PRODUCERS OF RED RASPBERRIES FOR PROCESSED MARKET.
(a) PROVISION OF ASSISTANCE-
The Secretary of Agriculture shall use $15,000,000 of funds of the Commodity
Credit Corporation to make payments to producers of the 2000 crop of red
raspberries grown for the processed market to compensate such producers
for loss of markets for processed red raspberries.
(b) PAYMENT BASIS- Subject
to such other terms and conditions as the Secretary considers appropriate,
a payment under this section shall be made on the basis of the quantity
of the 2000 crop of red raspberries that was produced on a farm unit and
marketed for processing.
(c) PREVENTION OF DUPLICATIVE
PAYMENTS- The Secretary shall take such actions as are necessary to ensure
that payments made under this section do not duplicate payments provided
under other Federal programs for the same loss, other than an indemnity
provided under a policy or plan of insurance offered under the Federal
Crop Insurance Act (7 U.S.C. 1501 et seq.).
(d) EMERGENCY DESIGNATION-
The entire amount necessary to carry out this section shall be available
only to the extent that an official budget request for the entire amount,
that includes designation of the entire amount of the request as an emergency
requirement as defined in the Balanced Budget and Emergency Deficit Control
Act of 1985, is transmitted by the President to the Congress. The entire
amount is designated by the Congress as an emergency requirement pursuant
to section 251(b)(2)(A) of such Act.
