bill; which was referred to the Committee on Energy and Commerce, and in
addition to the Committee on Agriculture, for a period to be subsequently
determined by the Speaker, in each case for consideration of such provisions
as fall within the jurisdiction of the committee concerned

To prohibit the use
of Federal funds to implement certain additional reductions in the production
or consumption of methyl bromide, unless the Secretary of Agriculture and
the Administrator of the Environmental Protection Agency have submitted
a report on the effects of methyl bromide on the ozone layer, and for other
purposes.
Be it enacted by the
Senate and House of Representatives of the United States of America in
Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as
the `Sound Science Methyl Bromide Act'.
SEC. 2. TEMPORARY PROHIBITION
ON USE OF FEDERAL FUNDS FOR IMPLEMENTATION OF ADDITIONAL METHYL BROMIDE
REDUCTIONS.
No Federal funds may be
used to implement any regulation that requires a reduction in the production
or consumption of methyl bromide after the date of the enactment of this
Act, unless--
(1) the Secretary of Agriculture
and the Administrator of the Environmental Protection Agency have submitted
the report on the effects of methyl bromide under section 3(a)(2); and
(2) the 3-month period described
in section 3(c)(2) has ended.
SEC. 3. STUDY ON EFFECTS OF
METHYL BROMIDE ON OZONE LAYER.
(a) STUDY AND REPORT- Not
later than 6 months after the date of the enactment of this Act, the Secretary
of Agriculture and the Administrator of the Environmental Protection Agency,
acting jointly, shall--
(1) conduct a study on the
effects of methyl bromide on the ozone layer; and
(2) submit to the Congress
a report describing the findings and conclusions of the study.
(b) ASSUMPTION OF NO ADDITIONAL
REDUCTIONS- Notwithstanding the phaseout regulations for methyl bromide
at part 82 of title 40, Code of Federal Regulations, the Secretary of Agriculture
and the Administrator of the Environmental Protection Agency shall assume
for purposes of the study and report that no reduction in the production
or consumption of methyl bromide will be made after the date of the enactment
of this Act.
(c) REVIEW BY NATIONAL ACADEMY
OF SCIENCES- The Secretary of Agriculture and the Administrator of the
Environmental Protection Agency, acting jointly, shall seek to enter into
an arrangement with the National Academy of Sciences under which the National
Academy of Sciences shall--
(1) prepare a written review
of the findings and conclusions in the report submitted to the Congress
under subsection (a)(2); and
(2) not later than 3 months
after the date of submission of that report, submit the written review
to the Congress.
SEC. 4. STUDY ON USE AND PRODUCTION
OF METHYL BROMIDE BY OTHER NATIONS.
Not later than 4 months
after the date of the enactment of this Act, the United States Trade Representative
shall--
(A) identify each nation
that increased use or production of methyl bromide after 1991;
(B) quantify such increase
by each such nation; and
(C) identify each nation
that will prohibit the importation of a United States product if methyl
bromide is not used for that product; and
(2) submit to the Congress
a report describing the findings and conclusions of the study.
